General
The following Terms and Conditions (GTC) apply to all contracts, deliveries and other services.
Differing rules of the contractor, we hereby expressly contradict. All agreements require written confirmation from our side. We, DessousBrasil, are always entitled to change these terms and conditions including all possible plants with adequate notice or supplement. Previously incoming orders are processed according to the still valid old general business conditions.
Quality Guidelines
We only sell new goods.
Colors are natural, can vary and are based on light and location.
Small deviations in relation to illustrations or descriptions are possible
For production we use a skin-friendly chrome-free paint material such as Lycra.
Order
The purchase comes with the order. This may be by telephone, email, mail or directly in the online shop. There is no minimum order value of a shipment. Unless otherwise agreed, the delivery from warehouse of DessousBrasil or one of its suppliers. Delivery will be made by SEDEX Economy.
From DessousBrasil deadlines and dates are not binding.
DessousBrasil strives to deliver the ordered goods within 12 to 16 working days to the customer. Can a delivery not be made within 3 weeks of the order, the customer may, unless otherwise agreed, withdraw from the contract.
We deliver within the European Countries (EU) USA, Argentine, Austria and Switzerland.
Payment / shipping
The purchase price is payable immediately when the goods are ordered.
With your first order we will send you a customer number.
The customer can make the payment only by PayPal
The invoice is made out of order and shows addicional shipping costs.
All our prices include VAT.
For orders with a value less than 25 € we will charge an addicional minimum order surcharge of 3,00€.
The from DessousBrasil purchased goods subject to these payment and shipping terms.
Arrears
If the customer is in default with its payments, the outstanding amount to be interest in the amount of 3% above the base rate of the European Central Bank. The customer has the right to prove the extent that DessousBrasil has incurred little or no damage. DessousBrasil reserves the right to assert further claims against explicitely. A discount is impermissible.
Retention of title
DessousBrasil reserves the ownership of the purchased goods until the customer has the purchase price paid completely for the whole order.
Complaints
The revocation period is sufficient to send the cancellation or the goods to DessousBrasil. In the case of an effective cancellation the mutually received benefits are to be returned and issue any benefits. If the consumer zurueckgewaehren performance received whole or only partly or only in deteriorated condition, he must pay compensation. With the surrender of goods this does not apply if the deterioration of the goods to their examination - as in a retail business would be have been possible - is due. Consumers can avoid the compensation obligation by the goods like an owner in use and omitting everything, which impairs their value. When a delivery of goods to Ruecksendung DessousBrasil, whose total order value amounts to 40 € to Gross, the consumer has to bear the cost of Ruecksendung even if the delivered merchandise corresponds to the order. The Ruecksendung occurs at a value over EUR 40, - gross cost and risk of the seller.
Exchange / Rueckgaberecht
You have a one-month exchange period with money back guarantee if not satisfied and complaint, without providing a reason. The exchange must take place within the period from the invoice date.
Exchange is possible due to hygienic reasons, only in case of wrong delivery or manufacturing defects. Goods must be boxed, unused and as shipped to be. For the rear delivery, a copy of the original invoice must be attached. Editing is not possible otherwise rear deliveries to DessousBrasil have to be franked sufficiently. Not cleared packets are not accepted by our customer service. Shipping and bank transfer will not be refunded. When damaged in transit you have to complain in writing within 48 hours, since otherwise the claim for free replacement.
Warranty
In the delivered goods, the liability is limited to replacement. Claims for rescission of the contract or reduction of compensation are excluded, unless replacement is possible within a reasonable period. Objections based on defects in the goods can be made in writing within 8 days. If the review of the defective goods that the defects are due to culpable conduct of the buyer (eg damage due to improper treatment), the buyer bears the cost of replacement.
